RETURNS AND EXCHANGES OF GOODS

According to the Law of Ukraine "On Consumer Protection", there are two situations of exchanging or returning purchased goods:

  1. RETURN OF GOODS OF INADEQUATE QUALITY:

According to Art. 8 of this Law, if significant defects are found that have arisen through the fault of the manufacturer of the goods, during the warranty period the consumer has the right to replace the goods or get a refund.
A significant defect, according to Clause 12, Article 1 of the Law of Ukraine “On Protection of Consumer Rights” , is considered a defect that makes it impossible or inadmissible to use the goods in accordance with their intended purpose, arose through the fault of the manufacturer, after its elimination appears again for reasons beyond the consumer’s control and is endowed with at least one of the following features:
a) it cannot be eliminated at all; b) it takes more than fourteen calendar days to eliminate it; c) it makes the goods significantly different from those provided for in the contract.

If it is necessary to check the quality of the goods, an examination may be carried out, during which the fact of violation by the consumer of the warranty conditions of the operation of the goods is established. In accordance with clause 4 of article 17 of the Law of Ukraine "On Protection of Consumer Rights", the examination is organized within three days from the date of receipt of the consumer's written consent to conduct an examination of the products. If, based on the results of the examination, it is proven that the defects arose after the transfer of the goods to the consumer and subsequently the consumer violated the rules of operation, storage and transportation, the consumer's claims are not subject to satisfaction, and the consumer is obliged to reimburse the costs of conducting the examination.

The consumer's request for replacement of the goods shall be satisfied immediately if it is available, and in the event of its absence - within two months from the date of filing the application. If it is impossible to satisfy the request within the established period, the consumer has the right, at his choice, to demand replacement of the goods with defects with another product of another brand (model) of proper quality with an appropriate transfer of the price or a refund. The consumer's requests for a refund shall be satisfied within seven days. Settlement with the consumer in the event of an increase in the price of the goods shall be made based on the cost of the goods at the time of their purchase.

  1. RETURN OF GOODS OF PROPER QUALITY IF THE GOODS DID NOT REACH THE BUYER FOR ANY REASON.

According to Article 9 of the Law of Ukraine "On Protection of Consumer Rights", the consumer has the right, within 14 days, to replace the goods of proper quality with a similar one, if the goods do not fit in shape, dimensions, style, color or cannot be used for their intended purpose, but provided that the goods have not been used and their presentation, consumer properties, seals, factory packaging, and documents have been preserved.

If at the time of exchange a similar product is not available for sale, the consumer has the right to purchase any other products, or to receive a refund in the amount of the value of the returned product, or to exchange the product for a similar one when the corresponding product first becomes available for sale. The money is returned within seven to fourteen days.
The consumer's requirements are considered only after specifying the customer's name and order number, the full set of the product, the factory packaging with a barcode, and the warranty card. Replacement of the product or refund of money is possible only if all conditions and procedures are met.

You will be denied a replacement or refund if:

a product that does not have significant defects is not new, i.e. has been used;

more than 14 days have passed since the purchase of the goods;

when checking the quality of the goods, signs of third-party interference (opening, attempted repair) or other warranty service conditions have been violated;

there is no document confirming the fact of purchase of the goods, or a warranty card, complete set of goods.

We also draw your attention to the fact that, according to clause 3, article 4 of the Law of Ukraine "On Protection of Consumer Rights", the consumer is obliged to:

1) before starting to use the product, carefully read the operating rules set out in the product documentation provided by the store;
2) if necessary, obtain clarification of the conditions and rules for using the product - before starting to use the product, contact the seller for clarification; 3) use the product in accordance with its intended purpose and comply with the conditions (requirements, norms, rules) established by the manufacturer of the product in the operating documentation; 4) in order to prevent negative consequences for the consumer regarding the use of the product - comply with the safety methods provided by the manufacturer in the product and special rules provided by the operating documentation, and in the absence of such rules in the documentation - comply with the usual understandable safety methods established for products of this type.

The return and replacement of goods sent by the CINQ store to various cities of Ukraine is carried out by the buyer returning the goods via delivery services, in particular Nova Poshta.

The return of money is carried out cash on delivery. The postal service undertakes to issue the goods only after the recipient has paid the declared value. This amount is transferred to the sender. This amount must correspond to the value of the returned goods. Before sending the goods, the buyer must contact the seller, discuss the terms of shipment and determine the name of the recipient of the goods (representative of the "CINQ" store).

If the reason for the return or replacement is the improper quality of the goods, then the store will pay for
the return shipment. If the purchased goods were of proper quality and the buyer picked them up from the Nova Poshta delivery point (did not refuse after inspection at the delivery point), but the goods did not suit the buyer for some reason within 14 days from the date of receipt, then the return shipment, as well as the transfer of money (after payment), is carried out by the buyer.

You have the right to return within 14 days (only if the product has not been worn, its properties, presentation and factory labels have been preserved), or in the event of an obvious factory defect of the product.

 

RETURN PROCESS

Contact the manager about the return and clarify all the information

Make sure that the product and all its accessories are available and in a presentable condition (except in the case of a factory defect).

Pack the goods in their original form and send them by Nova Poshta to the branch whose number was discussed with the manager.

Refunds based on the details are made within 7-14 business days after we receive the goods.

 

Goods that are not subject to return and exchange according to the legislation of Ukraine:

jewelry;

underwear;

swimsuits;

corsetry products;

gloves;

hosiery;

perfume.

 

In case of a factory defect: You must contact the manager and send us a photo of the defective product.
